END USER LICENSE AGREEMENT (EULA)

Map My Pay® Mobile Application

1. DEFINITIONS

  • "App" or "Application" means the Map My Pay® mobile software and any updates.
  • "Services" means the functionality the App provides (salary comparisons, calculators, community features, etc.).
  • "Subscription" means any recurring paid plan (Free, Plus, Pro) available inside the App.
  • "User Content" means any content you create, upload, or share, including paystubs, union contracts, and other documents.
  • "You," "your," or "User" means the person who downloads, installs, or uses the App

2. ACKNOWLEDGMENT

You and Map My Pay, LLC acknowledge that this Agreement is concluded between you and Map My Pay, LLC only, and not with Apple Inc. ("Apple") or Google LLC ("Google"), and that Map My Pay, LLC, not Apple or Google, is solely responsible for the Application and its content. This EULA is between you and Map My Pay, LLC only, and not with Apple or Google.

3. AGE REQUIREMENTS

You must be 16 years or older (13+ with verifiable parental consent) to create an account. We do not knowingly collect data from children under 13.

4. SCOPE OF LICENSE

4.1 License Grant: Subject to your compliance with this Agreement, Map My Pay LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your personal, non-commercial use on devices that you own or control, as permitted by the Us
4.2 License Restrictions: You agree NOT to:
  • Sell, rent, lease, sublicense, distribute, transmit, host, or otherwise commercially exploit the Application
  • Copy or use the Application for any purpose other than your personal, non-commercial use
  • Modify, decrypt, reverse compile, reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the Application
  • Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the Application
  • Use the Application in any way that violates applicable federal, state, local, or international law or regulation
  • Use the Application to transmit any harmful code or malware
  • Interfere with or disrupt the integrity or performance of the Application
  • Attempt to gain unauthorized access to the Application or its related systems
  • Violate the Usage Rules set forth in the App Store Terms of Service or Google Play Terms of Service

5. SUBSCRIPTIONS & BILLING (AUTO-RENEW)

Paid plans renew automatically at the end of each billing cycle unless canceled at least 24 hours before renewal. Manage or cancel anytime in your App Store/Google Play account settings. No prorated refunds are offered except where required by law.

6. MAINTENANCE AND SUPPORT

Map My Pay LLC is solely responsible for providing any maintenance and support services with respect to the Application, as specified in this Agreement, or as required under applicable law. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

7. WARRANTY

7.1 Limited Warranty: For 90 days after first download, we warrant that the App will perform substantially as described in its documentation. Your exclusive remedy for breach of this warranty is repair, replacement, or—if obtained for a fee—refund of the purchase price.
7.2 Warranty Disclaimer: EXCEPT FOR THE LIMITED WARRANTY SET FORTH ABOVE, THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAP MY PAY LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7.3 Warranty Claims: Map My Pay LLC, and not Apple or Google, is responsible for addressing any claims relating to the Application or your possession and/or use of the Application. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application (if any) to you. To the maximum extent permitted by applicable law, Apple and Google will have no otherwarranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Map My Pay LLC’s sole responsibility.

8. PRODUCT CLAIMS

You and Map My Pay LLC acknowledge that Map My Pay LLC, not Apple or Google, is responsible for addressing any claims of you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Application’s use of any Apple frameworks such as HealthKit and HomeKit. This Agreement does not limit Map My Pay LLC’s liability to you beyond what is permitted by applicable law.

9. INTELLECTUAL PROPERTY RIGHTS

The Application and all contents, features, and functionality (including but not limited to allinformation, software, code, text, displays, graphics, photographs, video, audio, design,selection, and arrangement) are owned by Map My Pay LLC and are protected by United Statesand international copyright, trademark, patent, trade secret, and other intellectual property laws.Our trademarks and trade dress may not be used in connection with any product or servicewithout our prior written consent.In the event of any third party claim that the Application or your possession and use ofthe Application infringes that third party’s intellectual property rights, Map My Pay LLC,not Apple or Google, will be solely responsible for the investigation, defense, settlementand discharge of any such intellectual property infringement claim.

10. USER CONTENT AND SENSITIVE DOCUMENTS

10.1 Data Processing and Extraction: When you upload paystubs, wage statements, unioncontracts, and other employment-related documents (“User Content”), you understand andagree that:
  • We may use automated processes to scan, extract, and analyze information from
  • uploaded paystubs and contracts
  • Extracted data may include salary information, tax withholdings, employer details, work
  • locations, and other employment-related information
  • We will process this information to provide the Application’s services, including salary
  • comparisons and financial calculations
  • Any personally identifiable information (PII) extracted will be handled in accordance with
  • our Privacy Policy
  • The license to process your User Content lasts only as long as necessary to provide the
  • Services or comply with legal obligations
10.2 License Grant: You retain ownership of your User Content, but by submitting User Contentthrough the Application, you grant Map My Pay LLC a worldwide, non-exclusive, royalty-freelicense to:
  • Process, scan, and extract data from your User Content
  • Use extracted data for providing and improving our services
  • Create anonymized and aggregated data for industry insights and comparisons
  • Store and backup your User Content and extracted data
10.3 Community Sharing: If you choose to share User Content in community features:
  • You are solely responsible for any information you choose to make public
  • We strongly recommend redacting all personal information before sharing
  • We are not responsible for other users’ use or misuse of your shared content
  • Anything you post publicly is at your own risk
10.4 Representations and Warranties: You represent and warrant that:
  • You own or have the necessary rights to upload and share your User Content
  • You have the legal right to share any paystubs or contracts you upload
  • Your User Content does not violate any confidentiality agreements or employment terms
  • Your User Content does not infringe any third-party rights
  • Your User Content complies with this Agreement and all applicable laws
  • You will not upload documents con

11. THIRD PARTY TERMS

You must comply with applicable third party terms of agreement when using theApplication. For example, if you have a VoIP application, then you must not be in violation ofyour wireless data service agreement when using the Application.

12. LEGAL COMPLIANCE & EXPORT

You represent and warrant that (i) you are not located in a country that is subject to aU.S. Government embargo, or that has been designated by the U.S. Government as a“terrorist supporting” country; and (ii) you are not listed on any U.S. Government list ofprohibited or restricted parties.

You may not use or otherwise export or re-export the Application except as authorized by UnitedStates law and the laws of the jurisdiction in which the Application was obtained. In particular,but without limitation, the Application may not be exported or re-exported (a) into any U.S.embargoed countries or (b) to anyone on the U.S. Treasury Department’s Specially DesignatedNationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By usingthe Application, you represent and warrant that you are not located in any such country or onany such list. You also agree that you will not use the Application for any purposes prohibited byUnited States law, including, without limitation, the development, design, manufacture, orproduction of nuclear, missile, or chemical or biological weapons.

13. PRIVACY AND DATA COLLECTION

Your use of the Application is also governed by our Privacy Policy, which can be found at https://mapmypay.com/privacy-policy. By using the Application, you consent to the collectionand use of your personal information as described in our Privacy Policy.

13.1 Types of Data Collected: The Application collects and processes:
  • Personal information you provide (email addresses, profile information)
  • Employment documents (paystubs, W-2s, union contracts, offer letters)
  • Financial information extracted from uploaded documents
  • Location data related to your employment
  • Usage data and analytics
13.2 Data Security: We implement industry-standard security measures to protect yoursensitive information, including:
  • Encryption of data in transit and at rest
  • Secure storage of uploaded documents
  • Access controls and authentication
  • Regular security assessments

However, no method of transmission over the Internet or electronic storage is 100% secure.While we strive to protect your personal information, we cannot guarantee its absolute security

13.3 Data Retention: We retain your personal information and uploaded documents for as longas necessary to provide our services and as required by law. You may request deletion of yourdata through the Application settings or by contacting us.
13.4 Data Location: Servers are located in the United States; by using the App you consent toU.S. data transfer and processing.
13.5 Compliance: Our data practices comply with applicable privacy laws including theCalifornia Consumer Privacy Act (CCPA) where applicable.

14. EXTERNAL SERVICES

The Application may enable access to Map My Pay LLC’s and/or third-party services andwebsites (collectively and individually, “External Services”). Links or data feeds from Zillow,Rocket Mortgage, or other providers are for informational purposes only. You agree to use theExternal Services at your sole risk. Map My Pay LLC is not responsible for examining orevaluating the content or accuracy of any third-party External Services, and shall not be liablefor any such third-party External Services. Data displayed by any Application or ExternalService, including but not limited to financial, medical and location information, is for generalinformational purposes only and is not guaranteed by Map My Pay LLC or its agents.

15. UPDATES AND MODIFICATIONS

We may regularly update the Application with new features, bug fixes, and improvements. Youagree that we may automatically download and install updates to the Application on your device.Some updates may be required for continued use of the Application. Continued use after anupdate means you accept the new version.
We reserve the right to modify, suspend, or discontinue the Application (or any part thereof) atany time with or without notice. You agree that we will not be liable to you or any third party forany modification, suspension, or discontinuation of the Application

16. FEEDBACK

If you provide us with any feedback, suggestions, or ideas regarding the Application(“Feedback”), you acknowledge and agree that:

  • We may use such Feedback without any obligation to compensate you
  • We may implement Feedback without crediting you
  • You hereby grant us a perpetual, irrevocable, worldwide license to use such Feedback

17. THIRD PARTY BENEFICIARY

You acknowledge and agree that Apple and Google, and Apple’s and Google’ssubsidiaries, are third party beneficiaries of this Agreement, and that, upon youracceptance of the terms and conditions of this Agreement, Apple and Google will havethe right (and will be deemed to have accepted the right) to enforce this Agreementagainst you as a third party beneficiary thereof.

18. BINDING ARBITRATION & CLASS-ACTION WAIVER

Any dispute will be resolved by final, binding arbitration under the AAA Consumer Rules inSacramento County, California. You and Company waive any right to jury trial or to participate ina class action. You may opt out within 30 days of first accepting this EULA by emailinglegal@mapmypay.com.

19. DISCLAIMER OF WARRANTIES

Except for the 90-day limited warranty, the App and Services are provided without warranties ofany kind—express, implied, or statutory—including merchantability, fitness for a particularpurpose, non-infringement, or accuracy.We do not warrant that:

  • The Application will meet your requirements
  • The Application will be uninterrupted, timely, secure, or error-free
  • The results obtained from use of the Application will be accurate or reliable
  • Any errors in the Application will be corrected
  • The data extraction from uploaded documents will be 100% accurate
  • The Application’s calculations or comparisons will be error-free

IMPORTANT: The Application provides information for general reference purposes only. Salarycomparisons, tax calculations, and financial projections are estimates based on available dataand should not be relied upon as professional financial, tax, or legal advice. Always consult withqualified professionals for decisions regarding your finances, taxes, or employment. Salaryestimates and financial projections are educational only and not professional advice.

20. DATA ACCURACY & EXTERNAL FEEDS

Tax rates, housing prices, and other data come from third-party sources that may changewithout notice. We make reasonable efforts to refresh data but do not guarantee accuracy,completeness, or availability at any given time.

21. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAPMY PAY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BELIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVEDAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, ORGOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THEAPPLICATION.Our total liability will not exceed:

  • For free users: US $100
  • For paid subscribers: The fees you paid in the 12 months before the claim

22. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Map My Pay LLC and its officers, directors,employees, agents, and suppliers from and against any claims, liabilities, damages, losses, andexpenses, including reasonable attorneys’ fees, arising out of or in any way connected with:

  • Your access to or use of the Application
  • Your violation of this Agreement
  • Your violation of any third-party rights
  • Your User Content, including any paystubs, contracts, or other documents you upload
  • Any breach of confidentiality or employment agreements resulting from your document uploads
  • Any claims related to unauthorized disclosure of personal or financial information in your User Content
  • Your sharing of sensitive documents in community features
  • Any inaccuracies in information you provide

23. HIPAA & PHI DISCLAIMER

The App is not intended to handle protected health information (PHI) under HIPAA. Do notupload patient records or clinical data.

24. FCRA DISCLAIMER

Company is not a “consumer reporting agency” under the Fair Credit Reporting Act and theServices must not be used to make credit, employment, or housing decisions about others.

25. SURVIVABILITY

Sections 7, 9, 10, 12, 17–24 and any licenses you grant to us survive termination.

26. TERMINATION

This Agreement is effective until terminated by either party. Your rights under this Agreement willterminate automatically without notice if you fail to comply with any term of this Agreement.Upon termination:

  • All rights granted to you under this Agreement will cease
  • You must stop all use of the Application
  • You must delete all copies of the Application from your devices

27. GOVERNING LAW & VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State ofCalifornia, without regard to its conflict of law provisions. The state or federal courts inSacramento County have exclusive jurisdiction for matters not subject to arbitration.

28. GENERAL PROVISIONS

Entire Agreement:This Agreement constitutes the entire agreement between you and Map MyPay LLC regarding the Application and supersedes all prior agreements and understandings.Waiver:No waiver by Company shall be deemed a continuing waiver.Severability:If any clause is unenforceable, the rest remains in effect.Assignment:You may not assign this EULA without consent; we may assign without restriction.Notices:All notices under this Agreement shall be in writing and deemed given when deliveredpersonally, sent by confirmed email, or sent by certified mail, return receipt requested.
